To begin with, it is worthwhile to provide appropriate explanations of who the transferee and transferee are.
A recipient is a legal entity that is registered in Ukraine and has a specific area of statutory activity. According to the current legislation, it is mandatory to register the recipient in the Unified Register of Recipients of Humanitarian Aid. This may include charitable foundations, NGOs, and rehabilitation institutions.
A recipient is an individual or legal entity that needs and has received humanitarian aid, i.e. a person or organisation to whom this aid is directly provided. This can include individuals as well as large institutions such as hospitals.


Recent legislative changes, including draft law No. 9111, expand the list of recipient legal entities. It now includes foreign charitable organisations whose representative offices are accredited in Ukraine. The category of recipients may also include non-profit state and municipal institutions, local governments, and social service providers.


With regard to the long-standing unresolved issue of charitable foundations purchasing goods abroad and importing them into Ukraine as humanitarian aid, this mechanism created legal risks. The purchased goods recognised as humanitarian aid had the potential to violate the law, as humanitarian aid should be provided free of charge. Draft Law No. 9111 regulates this situation by allowing charitable foundations to act as donors of humanitarian aid and import it into Ukraine free of charge.


Additionally, on 8 November, the Verkhovna Rada adopted in its entirety draft law No. 9111 on simplifying the procedure for the import, accounting and distribution of humanitarian aid. This draft law introduces an electronic system of humanitarian aid accounting at the legislative level. The relevant platform has already been developed and tested since 1 November. 


We also remind you that on 5 September, the Cabinet of Ministers adopted a resolution "Some issues of humanitarian aid entry and accounting under martial law", which changes the rules for the import and accounting of humanitarian aid starting from 1 December.
